1. Agreement to Terms

By accessing or using BuildForce AI's website, services, or platform (collectively, the "Services") at buildforce.ai, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and BuildForce AI ("we," "us," or "our"). If you do not agree to these Terms, do not use our Services.

2. Service Description

BuildForce AI provides AI-powered deployment automation and integration services for Salesforce and other SaaS platforms. Our Services include, but are not limited to, deployment automation, health checks, code analysis, and integration tools.

3. Disclaimer of Warranties and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDFORCE AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BUILDFORCE AI AND ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
  • ANY CONTENT OBTAINED FROM THE SERVICES;
  • UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
  • BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES;
  • ANY CHANGES MADE TO CONNECTED SAAS APPLICATIONS OR PLATFORMS;
  • ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF OUR SERVICES.

4. User Responsibilities and Conduct

You are responsible for your use of the Services and any content you provide. You agree not to misuse the Services or help anyone else do so. You specifically agree not to:

  • Use the Services for any illegal purpose or in violation of any laws;
  • Violate or infringe other people's intellectual property, privacy, or other legal rights;
  • Transmit any malicious code, files, or programs designed to interrupt or damage the Services;
  • Attempt to probe, scan, or test the vulnerability of our systems;
  • Interfere with or disrupt the Services or servers connected to the Services.

5. Data Usage and Analytics

By using our Services, you grant BuildForce AI the right to collect, analyze, and use data related to your use of the Services for the purposes of:

  • Improving and optimizing our Services;
  • Conducting research and development;
  • Generating aggregated analytics and statistics;
  • Marketing and promoting our Services;
  • Personalizing your experience;
  • Communicating with you about products, services, and updates.

6. Third-Party Services and Integrations

Our Services may integrate with or enable access to third-party services and platforms. You acknowledge that:

  • Your use of such services is governed by their respective terms of service and privacy policies;
  • BuildForce AI is not responsible for the content, accuracy, or practices of third-party services;
  • BuildForce AI shall not be liable for any damage or loss caused by third-party services;
  • Integration with third-party services is provided "AS IS" without any warranties.

7. Intellectual Property Rights

The Services and their original content, features, and functionality are owned by BuildForce AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located within Delaware.
